Our MDA allows artists and music producers to record, mix, produce music, and collaborate on the production of music, as well as to distribute their music and collaborations through social media networks. This service requires artists and producers, including you (collectively the “Users”), to upload music content to our Site and Service. By using Speazie, you and the other Users grant us and each other certain rights with respect to how your music content may be used.
2. Q&A ON COPYRIGHT USE
To provide our Copyright Policy in the most readable possible form, we have written our policy in the form of a Q&A:
Q: What kind of music content may I upload to Speazie?
A: You may upload any original music content to which you own the exclusive rights to copy, reproduce, perform, and prepare derivative works (the “Copyrights”). Meaning, you may upload any music content that you, yourself have created without incorporating or copying any music created by someone other than yourself.
Q: What kind of music content may I record using Speazie?
A: You may use our Service to record and store any original singing or instrumental performances composed by you. To be clear: you may not use our Service to record or store your performance of songs composed by anyone other than yourself unless you have secured the rights to do so from the original composers and owners of the original composition.
Q: Who will own the rights to the music content I upload to or record using Speazie?
A: You are the exclusive owner of the rights to any original music content that you upload to or record using Speazie. However, by uploading or recording your original music content to Speazie, you grant Speazie and its other Users certain limited rights to use your music content as described below.
Q: What may other Users do with my music content?
A: By uploading or recording your music content to Speazie, you allow other Users to combine or incorporate your music content with their own original music content (including public performance of and in connection with your original music content), as well as any music content submitted to Speazie by other Users, to create and perform new music content using our Service.
Q: What may I do with the music content submitted by other Users?
A: You may combine or incorporate the music content submitted by other Users with your own original music content (including public performance of and in connection with music content submitted by other Users) to create and perform new music content using our Service.
Q: Who owns the rights to the new music content created by combining various Users’ music content using Speazie?
A: You and your collaborators shall co-own, as joint authors, the rights to any new music (including public performance) created by combining various Users’ music content using Speazie. Speazie shall be granted a perpetual, irrevocable right to play, sublicense, monetize, create derivative works of and otherwise use such new music content (and public performance) as well.
Q: What may I do with any new music content that I create using Speazie?
A: You may promote and share any new music content that you create using our Service to social media networks via the sharing tools provided by our Service as well as sharing your new music content (including public performance) on our Service.
Q: May I download new music content that I create using Speazie’s Service to my computer?
A: No, you may not download new music content that you create using our Service to your computer.
Q: May I download other Users’ music content to my computer?
A: No, you may not download other Users’ music content to your computer, and other Users may not download your original music content to their computers.
Q: Why can’t I share new music content that I create using Speazie via services outside of Speazie?
A: The Speazie Service was created to provide artists and music producers with the ability to promote their original content by collaborating and creating new music content using the Service and sharing such new music content via the Service. You may not download or share new music content created using our Service via services outside of Speazie because such sharing would prevent us from ensuring that the relevant Users are properly credited for their original contributions to the new music content.
We may amend this Copyright Policy from time to time. When we amend this Copyright Policy, we will post the changes here and e-mail you to inform you that there has been a change. Your continued use of our Service shall constitute your acceptance of such changes.
